FOSS Patents stories that Apple has filed a movement to intervene in the proceedings Lodsys has filed in opposition to seven iOS builders.
Apple Inc. (“Apple”) hereby respectfully moves to intervene as a defendant and counterclaim plaintiff in the above-captioned motion brought by means of plaintiff Lodsys, LLC (“Lodsys”) against seven tool application developers (jointly, “builders”), forallegedly infringing U.S. Patent Nos. 7,222,078 (the “078 patent”) and seven,620,565 (the “565 patent” and, collectively, the “patents in suit”). Apple seeks to intervene because it’s expresslyl icensed to provide to the builders products and services that embody the patents in go well with, free from claims of infringement of those patents.
With the move, Apple is trying to interject itself within the proceedings that it has otherwise no longer been a participant in. FOSS Patents believes its likely that Apple will probably be allowed in, although Lodsys can oppose the movement.
also, whereas there’s been no public confirmation, the website online believes its possible that Apple has agreed to cover the defendant’s costs and doable dangers as “it is arduous to imagine how else this might work.”
Apple states explicitly that the sued app builders are “are folks or small entities with far fewer instruments than Apple and […] lack the technical data, ability, and incentive to properly offer protection to Apple’s rights underneath its license settlement.”
